● Fiat Currency: Refers to government-issued currency that is designated as legal tender.
● Service or Service Provider: Refers to EuOTC, providing cryptocurrency trading services.
● Service Agreement: An agreement between the Customer and the Service Provider regarding the services provided.
● Commission Fee: A fixed fee charged by the Service Provider for a virtual currency exchange transaction and related services.
● KYC: Means Know Your Customer, the process of verifying the identity of our users.
● AML: Means Anti-Money Laundering, the regulations designed to prevent the practice of generating income through illegal actions.
● CTF: Counter-Terrorist Financing.
● PEP: Politically Exposed Person.
● Transaction: Refers to any exchange of cryptocurrency for fiat currency or vice versa, or any exchange between different cryptocurrencies.
- By using our Service, you represent and warrant that you are at least 18 years old and have the full capacity to accept these Terms and enter into a transaction involving cryptocurrencies.
- Not be subject to any EU or UN sanctions.
- You further represent and warrant that you are not a citizen or resident of any state, country, territory or other jurisdiction where your use of our Services would be illegal or otherwise violate any applicable law.
- You represent and warrant that you are not on any trade or economic sanctions lists, such as the UN Security Council Sanctions list or OFAC.
- Use wallets and accounts that are opened in your own name; third-party wallets or accounts are not permitted.
- Provide genuine, unaltered KYC documents; forged or altered documents are strictly prohibited.
- Not be a Politically Exposed Person (PEP) or have known connections to PEPs.
- Not be over the age of 70.
- Not be a shell bank or provide services to shell banks.
- Do not engage in activities such as private banking, gambling, virtual assets, or any other prohibited high-risk industries.
● Compliance with Laws and Regulations: Users must comply with all applicable local, national, and international laws related to cryptocurrency trading and not engage in any prohibited activities as defined by EuOTC.
- To use our Service, users must complete the registration process by creating an account. You agree to provide accurate, current, and complete information during the registration process and keep it updated.
- Any false or misleading information may result in account suspension or termination.
- You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
- You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.
● Description of Services EuOTC provides Over-the-Counter (OTC) cryptocurrency trading services, including the buying and selling of various cryptocurrencies. Our services are designed for secure, compliant, and efficient cryptocurrency transactions.
● Service Limitations and Availability: EuOTC reserves the right to refuse service to any user who does not comply with our eligibility criteria, AML/CTF and KYC requirements, or if there is suspicion of illegal activity.
We reserve the right to modify or discontinue, temporarily or permanently, the Service (or any part thereof) with or without notice.
- Virtual Currencies: Our primary cryptocurrencies are USDT, BTC, and ETH, and we offer transactions in USD and EUR.
- Minimum Transaction Amount: The minimum amount for a virtual currency exchange transaction is …………….EUR or its equivalent in the virtual currency.
- Commission Fees: A commission fee is charged for each transaction, calculated based on the type of virtual currency, network load, and the number of transactions in the queue. The fee is indicated before the transaction.
- Exchange Rate Determination: The virtual currency exchange rate is determined at the moment of transfer when selling, and post-KYC when buying.
● Once initiated, transactions cannot be reversed. You are responsible for verifying all transaction information before confirming a transaction.
● We reserve the right to refuse, delay, or cancel any transaction at our sole discretion, particularly if we suspect the transaction may be illegal or violate our AML policies.
● Transaction limits may be placed on your account based on your verification level and our internal policies.
● By initiating a transaction on our platform, you agree to be bound by the specific terms of that transaction, including the exchange rate and any applicable fees.
EuOTC adheres to strict AML/CTF measures to prevent and detect money laundering and terrorist financing. All users are required to undergo our KYC verification process.
You agree to provide all information requested for KYC purposes, which may include, but is not limited to, your full name, address, date of birth, nationality, government identification numbers, and other information.
You consent to us keeping a record of this information and sharing it with appropriate regulatory or law enforcement authorities where we are required to do so by applicable law.
We reserve the right to refuse service, terminate accounts, or cancel transactions if we suspect any violations of our KYC and AML policies.
Users are categorized based on their risk level for money laundering (ML) and terrorist financing (TF):
- High-Risk Clients: Subject to Enhanced Due Diligence (EDD), continuous transaction monitoring, and regular reviews every 6-12 months.
- Medium-Risk Clients: Subject to regular monitoring and reviews every two years.
- Low-Risk Clients: Subject to Simplified Due Diligence (SDD) measures with reviews every three years or upon triggering events.
- Enhanced Due Diligence (EDD): Applies to High-Risk Clients, including additional document requirements and closer monitoring.
- Simplified Due Diligence (SDD): Applies to Low-Risk Clients, involving less stringent verification and monitoring measures.
● We charge fees for our Services. These fees are clearly displayed before you confirm any transaction.
● You agree to pay all fees associated with your use of our Service. We reserve the right to change our fee structure at any time.
● All fees are due immediately and are non-refundable. This includes cases where a transaction is cancelled or reversed.
You agree not to engage in any of the following prohibited activities:
● Violating any laws, regulations, or rights of others, including intellectual property rights.
● Using the Service for any illegal purposes, including money laundering, terrorist financing, or fraud.
● Interfering with or disrupting the Service or servers or networks connected to the Service.
● Attempting to gain unauthorized access to any portion of the Service or any other systems or networks connected to the Service.
● Using the Service to transmit any viruses, worms, defects, Trojan horses, or any items of a destructive nature.
● Harassing, abusing, or harming another person through the Service.
● Impersonating any person or entity or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

● No Investment Advice: EuOTC does not provide any investment, tax, or legal advice. All decisions made regarding the purchase or sale of cryptocurrency are the user's responsibility.
● Data Collection and Use: EuOTC collects, stores, and processes personal data in accordance with our Privacy Policy. By using our services, you consent to our collection, use, and sharing of data as described in our Privacy Policy.
